Terms and Conditions
Effective date: 1 April 2026
1. Introduction
These terms and conditions ("Terms") govern all services provided by WISP Electrical Ltd (NZBN pending) ("WISP", "we", "us", "our"), a registered electrical contractor operating in the Nelson and Tasman region of New Zealand.
By engaging us for any service, including electrical work, wireless internet, heat pumps, security installations, networking, or smart automation, you ("the Customer", "you") agree to be bound by these Terms. Where a separate written agreement exists between you and WISP, the terms of that agreement prevail to the extent of any inconsistency.
Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
2. Quotes and Pricing
- All quotes are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated in writing.
- All prices are in New Zealand Dollars (NZD) and include GST unless explicitly stated otherwise.
- A quote is an estimate only unless described as a "fixed price". Final invoiced amounts may vary if the scope of work changes or unforeseen conditions are encountered. We will advise you before incurring any additional costs where reasonably practicable.
- For work performed without a prior quote (e.g. emergency call-outs), our standard hourly rates apply. These rates are available on request.
3. Acceptance and Scheduling
- A quote is accepted when you confirm acceptance in writing (including email or text message), or when you instruct us to proceed with the work.
- We will schedule work as promptly as reasonably possible. Scheduled dates are indicative and may be affected by weather, supply delays, or other factors beyond our control.
- If you need to reschedule or cancel confirmed work, please give us at least 24 hours' notice. Cancellations with less than 24 hours' notice may incur a call-out fee.
4. Electrical Services
- All electrical work is carried out by licensed electricians registered with the Electrical Workers Registration Board of New Zealand, in compliance with the Electricity Act 1992, the Electricity (Safety) Regulations 2010, and the AS/NZS 3000 Wiring Rules.
- A Certificate of Compliance (CoC) or Electrical Safety Certificate (ESC) will be issued for all prescribed electrical work as required by regulation.
- We guarantee our workmanship for a period of 12 months from the date of completion. This guarantee covers defects in workmanship but does not cover damage caused by misuse, third-party interference, or normal wear and tear.
- Equipment and materials supplied by WISP carry the manufacturer's warranty. We will assist you with warranty claims where applicable.
5. Wireless Internet Service
- Wireless internet service is subject to coverage and line-of-sight availability at your address. We will conduct a site assessment before confirming service availability.
- An installation fee may apply. Equipment installed at your premises (including antennas and routers) remains the property of WISP Electrical Ltd unless otherwise agreed.
- Service plans, speeds, and pricing are as published on our website or as agreed in your service agreement. We reserve the right to adjust plan pricing with 30 days' written notice.
- Service performance may vary due to factors including weather conditions, network congestion, distance from the access point, and local interference. Advertised speeds represent maximum achievable speeds under optimal conditions.
- Internet services are provided on a month-to-month basis unless a fixed-term agreement is in place. Either party may terminate the service with 30 days' written notice.
- We will use reasonable endeavours to maintain network availability but do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance where possible.
- You agree not to use the service for any unlawful purpose, to send unsolicited bulk communications (spam), or in any way that degrades the network for other users.
5.1 Referral Program
Existing customers who refer a new customer will receive one month of free service once the referred customer has been connected and maintained an active account for at least 30 days. This offer:
- Cannot be combined with other promotions unless explicitly stated
- Is limited to one referral credit per referred customer
- May be withdrawn or modified at any time with reasonable notice
6. Heat Pump Services
- We supply, install, service, and repair heat pump systems. All installations comply with manufacturer specifications and New Zealand electrical safety standards.
- Heat pump equipment carries the manufacturer's warranty (typically 5-6 years; refer to manufacturer documentation for specifics). Our installation workmanship is guaranteed for 12 months.
- We recommend annual servicing to maintain equipment performance and warranty validity. Servicing schedules and pricing are available on request.
- Warranty claims for equipment defects will be managed by us on your behalf with the manufacturer where the unit was supplied by WISP.
7. Security and CCTV Installations
- We design and install CCTV, access control, and intrusion detection systems. System design recommendations are based on our professional assessment of your requirements.
- Installed equipment carries the manufacturer's warranty. Installation workmanship is guaranteed for 12 months.
- CCTV systems are designed for self-monitoring. We do not provide a professional monitoring service. You are responsible for the ongoing management, storage, and review of recorded footage.
- You are responsible for ensuring your use of CCTV complies with the Privacy Act 2020, including appropriate signage and data handling practices. We can advise on best practice but compliance is your responsibility.
8. Networking and Smart Automation
- Networking services include structured cabling, Wi-Fi design, equipment configuration, and cloud-managed network solutions.
- Smart automation services include home automation, power monitoring, and IoT integration.
- Where we configure third-party cloud services (e.g. network management platforms), ongoing subscription costs are your responsibility unless otherwise agreed.
- We will provide handover documentation including login credentials and system configurations at the completion of the project.
9. Payment Terms
- Payment is due within 14 days of the invoice date unless otherwise agreed in writing.
- For projects exceeding $2,000 (incl. GST), we may require a 50% deposit before work commences, with the balance due on completion.
- For larger projects, progress payments may be required as outlined in the project agreement.
- We accept payment by bank transfer, credit/debit card, and cash.
- Overdue invoices may incur interest at a rate of 1.5% per month on the outstanding balance. We reserve the right to suspend services or withhold Certificates of Compliance for overdue accounts.
- Wireless internet service may be suspended if payment is more than 14 days overdue. Service will be restored within 24 hours of payment being received.
10. Access and Site Requirements
- You must provide safe and reasonable access to the work site. If access is restricted or hazardous, additional charges may apply.
- You must disclose any known hazards (e.g. asbestos, structural issues) before work begins.
- If work cannot proceed due to site conditions outside our control, a call-out fee may apply.
11. Liability
- We hold comprehensive public liability insurance and professional indemnity cover.
- Our liability for any claim arising from the supply of services is limited to the value of the services provided, except where liability cannot be limited by law (including under the Consumer Guarantees Act 1993).
- We are not liable for indirect or consequential loss, loss of profits, loss of data, or business interruption, except to the extent such exclusion is prohibited by law.
- We are not liable for damage caused by pre-existing defects, third-party actions, acts of nature, or the Customer's failure to follow our advice or recommendations.
12. Privacy
- We collect and hold personal information in accordance with the Privacy Act 2020.
- Personal information is collected for the purposes of providing our services, communicating with you, invoicing, and meeting our legal obligations.
- We will not share your personal information with third parties except as necessary to provide our services (e.g. equipment suppliers for warranty claims), or as required by law.
- You have the right to access and request correction of your personal information held by us. Requests can be made by contacting us at admin@wispelectrical.co.nz.
13. Dispute Resolution
- If a dispute arises, we encourage you to contact us first so we can attempt to resolve the matter directly.
- If the dispute cannot be resolved informally, either party may refer the matter to mediation. The costs of mediation will be shared equally.
- These Terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction.
14. Termination
- Either party may terminate a service agreement by giving the notice specified for that service type (see relevant sections above).
- We may terminate or suspend services immediately if you breach these Terms, fail to make payment when due, or use our services unlawfully.
- Upon termination of wireless internet service, WISP-owned equipment must be returned within 14 days or a replacement charge may apply.
15. General
- We may update these Terms from time to time. Updated Terms will be posted on our website. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- These Terms, together with any accepted quote or service agreement, constitute the entire agreement between you and WISP Electrical Ltd.
